MANKATO (TEC News) – Blue Earth County prosecutors have asked a judge to sign an order that would essentially compel two men to testify against alleged “Family Mob” gang member Richard Gordon during his drug trial.
The prosecution says the “use immunity” order would protect both Armand Smith and Cedric Berry from having evidence they provide against Gordon from being used against them in their own cases.
But attorneys for the men say there is no guarantee it couldn’t be used if federal charges would be filed.
Judge Walker has taken matter under advisement.
