Change Of Venue Possible For Munt Murder Trial



MANKATO -- When Joel Munt walks into a courtroom on September 12 for his murder trial one big questIon remains.

Will it be in Mankato or in another community.

Munt's attorney Scott Cutcher made it clear after today's short pretrial hearing in Blue Earth County District Court that a change of venue motion is something they are entertaing.

"Probably that last week (before trial) we'll most likely be filing a motion for a change of venue." said Cutcher.

The request on the grounds of pretrial publicity could come as as late as during jury selection according to Cutcher.

"One of biggest fears is that one of the jurors will say 'you know, we've all been talking about this and we've made our mind up...which has happened a few times." said Cutcher. "Then you're done."

Cutcher say they could also so a man on the street survey. Hire a couple law students to stand on a corner and ask the public questions about what they know about the case. He admits it's not scientific, but would be part of an overall request to change venue.

Orginally set for three weeks, the Munt murder trial is set for two weeks beginning September 12.

Cutcher says jury selection alone could take a week.
